House Democrats blocked a Republican request Wednesday that would have prevented the expansion of the Supreme Court.

The Republican resolution proposed an amendment to the Constitution requiring the Supreme Court to be composed of nine justices — as it has been for the past 153 years, Rep. Tom Cole (R-OK) pointed out Wednesday.

“Fundamentally changing the composition of the court to satisfy the demands of one political party would permanently erode the independence of the judicial branch and forever alter the separation of powers, which is the very foundation our constitution and our nation were built upon,” Cole warned.

But Democrats blocked the resolution on Wednesday.

“Where does it end?” asked Rep. Dusty Johnson (R-SD), citing the late Supreme Court Justice Ruth Bader Ginsberg’s opposition to packing the court. “Once this body establishes that the size of the court can grow only so that we can secure the preferred judicial decisions of the House majority, where does it end?”

Senate Democrats are currently divided in their discussions over whether they support expanding the Supreme Court, The Hill reported Wednesday. As they discuss reforms, such as increasing the number of justices and imposing term limits, the Democrats recognize that they do not have the votes necessary to enact these policies.

The ideas are fueled by the overturn of Roe v. Wade in Dobbs vs. Jackson Women’s Health Organization and other monumental cases as of late, the publication reported.

Liberal groups and lawmakers have repeatedly pushed to pack the court. Such calls have become more frequent in recent months as Democrats and leftist activists observe Justice Clarence Thomas’s influence growing. They now realize they have “lost their stronghold on the court,” Judicial Crisis Network President Carrie Severino told The Daily Wire earlier this year.

The left long took the court for granted, Severino said, believing the Supreme Court was “their ace in the hole for getting policies achieved that they couldn’t do through the elected branches.”

Now that this is not the case, Democrats and leftist activists widely advocate for expanding the court.
