A legal group led by Stephen Miller, who was a top aide to former President Donald Trump, has filed a lawsuit against the Biden administration alleging funds reserved for “socially disadvantaged farmers and ranchers” amounts to discrimination against white farmers.

According to the complaint, the U.S. Department of Agriculture is “actively and invidiously discriminating against American citizens solely based upon their race.”

The suit was filed by America First Legal on behalf of Texas Agriculture Commissioner Sid Miller and others. The proposal is part of President Joe Biden’s America Rescue Plan. Miller is acting in the lawsuit as a private citizen and not in his official capacity, according to AFL.

“The United States Department of Agriculture administers numerous statutes that provide government aid to ‘socially disadvantaged farmers and ranchers,” according to the complaint.

“America First Legal opposes discrimination in all forms,” Miller said in a statement announcing the lawsuit. “We hold fast to the immortal words of Martin Luther King Jr. that Americans ‘should not be judged by the color of their skin, but by the content of their character.'”

“MLK’s vision is fundamental to our democracy, in which all citizens are equal both in front of the law and in the eyes of their Creator,” Miller continued. “For this reason, AFL is filing a lawsuit today against the Biden Administration to prevent it from administering programs created under the American Rescue Plan Act that discriminate against American farmers and ranchers based upon the basis of race.”

Miller also quoted Chief Justice John Roberts’ words in a 2007 ruling: “[T]he way to stop discrimination on the basis of race is to stop discriminating on the basis of race.”

The USDA told Newsmax Wednesday it was “reviewing the complaint and working with the Department of Justice.

“During this review, we will continue to implement the debt relief to qualified socially disadvantaged borrowers under the American Rescue Plan Act,” a spokesperson added. 

Miller announced the creation of America First Legal earlier this month, saying its purpose was “resisting the radical left’s agenda.”

“For too long, conservative and traditionalist Americans have been outflanked, outspent, out-organized, and outmaneuvered by radical progressive legal organizations,” Miller said at the time. “It has been a years-long, one-sided legal assault. The consequences for American values, American society, and the American Constitution have been tragic and profound.”

Miller told The Wall Street Journal that the group planned to use lawsuits in Texas, much as liberal groups did to fight Trump policies in the courts.

Trump praised the group’s efforts, saying, “As we know, the Radical Left has been relentless in waging their battles in court. Conservatives and America First supporters badly need to catch up and turn the tables, which is why I applaud Stephen and Mark Meadows [his former chief of staff] for rushing to fill this critical void.”
