As many as five babies who survived attempted abortions in Minnesota appear to have been left to die, a report from the state Health Department found.

According to the state’s Born Alive Infants Protection Act, a born-alive infant resulting from an induced abortion is recognized as a living human. The law requires that “reasonable measures consistent with good medical practice shall be taken by the responsible medical personnel to preserve the life and health of the born alive infant.”

“For the calendar year of January 1, 2021, through December 31, 2021, 5 abortion procedures resulting in a born-alive infant were reported,” the health department report detailed.

In one instance, a baby with fetal “anomalies” died “shortly after delivery.” The report adds that “no measures taken to preserve life were reported and the infant did not survive.”

Two other born-alive babies received “comfort care measures” but “did not survive.” The “comfort and care measures” are not defined in the account, first reported by The Daily Caller.

Two more born-alive babies, described in the report as “previable,” also had no reports that they received any care in an effort to save their lives. The gestation of the babies is not reported.

Scott Smith, a communications specialist for the Minnesota Department of Health (MDH), directed The Daily Wire to the department’s Abortion Reporting System page when asked for comment on the matter. Smith said he could not further comment on the specific cases, per Minnesota law.

“As part of that system, MDH is required by law to maintain the confidentiality of the underlying case data and does not provide any comment about cases beyond what is in the report,” Smith said, citing Minn. Stat. sec. 145.4134.

Congressional Democrats have largely refused to pass legislation that protects born-alive babies from botched abortions.

In recent years, Sen. Ben Sasse (R-NE) has attempted to push the “Born-Alive Abortion Survivors Protection Act” through Congress.

The legislation would mandate doctors attempt to save born-alive infants instead of allowing them to die and criminalizes anyone who “intentionally performs or attempts to perform an overt act that kills a child born alive.”

“If an abortion results in the live birth of an infant, the infant is a legal person for all purposes under the laws of the United States, and entitled to all the protections of such laws,” the legislation said, adding, “Any infant born alive after an abortion or within a hospital, clinic, or other facility has the same claim to the protection of the law that would arise for any newborn, or for any person who comes to a hospital, clinic, or other facility for screening and treatment or otherwise becomes a patient within its care.”

During a vote in 2019, only three Democrats voted for the bill: Sen. Bob Casey Jr. (D-PA), Sen. Joe Manchin (D-WV), and Sen. Doug Jones (D-AL).

The legislation failed to pass the Senate with a vote of 53-44.
