The Biden administration has extended a Trump-era policy, which allowed for illegal immigrants to be turned away at the border to help stop the spread of COVID-19. On Monday, the CDC announced the so-called Title 42 policy would remain in effect until there was no longer a health threat from non-citizens.

This comes after the White House has faced backlash for their failures to enforce the policy, while allowing thousands of COVID positive illegals to be transported and released into cities around the country. In addition, a record number of unaccompanied minors were stopped at the border last month.

Critics have argued exemption from this rule for minors would exacerbate the problem.

“We know how that’s going to be translated by the coyotes and the cartels, but still it was a step in the right direction,” Rep. Michael Burgess (R-Texas) explained. “I will give the Biden administration credit for that. It was late it should have happened easily a month ago.”

The renewal of Title 42 came after the American Civil Liberties Union revived their lawsuit to overturn the order on Monday. In a court filing, the DHS responded the U.S. has encountered a record number of 210,000 illegal immigrants in July alone, which has strained operations, filled facilities beyond normal operating capacity and created a significant health risk.
